These Terms & Conditions apply to your use of the Paperswan Bride website and to the purchase of wedding gowns, accessories, products and services from Bonjour Beloved LTD trading as Paperswan Bride ("Paperswan Bride", "Paperswan", "we", "us" or "our").

By using our website, booking an appointment with us, or purchasing a product or service from us, you agree to these Terms & Conditions.

These Terms & Conditions are intended to provide general information about our terms of trade and our website. When you purchase a wedding gown from Paperswan Bride, you will also be provided with a Sale & Purchase Agreement setting out the specific details of your order, including the gown ordered, price, measurements, payment terms and expected delivery timeframe.

If there is any inconsistency between these website Terms & Conditions and a specific written Sale & Purchase Agreement signed by you and Paperswan Bride, the terms of the signed Sale & Purchase Agreement will apply to that individual purchase, unless otherwise required by law.

1. About Paperswan Bride

Paperswan Bride is a bridal boutique offering wedding gowns, bridal accessories and related bridal services through our boutiques in New Zealand.

Our website allows you to browse our collection of wedding gowns, designers, accessories and other information about our services. Although our website may display products and pricing in a "Shop" or catalogue-style format, wedding gowns cannot be purchased directly through our website.

Our online shop is a catalogue for browsing our collection only. To purchase a wedding gown, you will need to visit one of our boutiques or contact our team.

All wedding gown purchases are completed directly with Paperswan Bride following an in-person consultation and/or communication with our team.

Information displayed on our website is intended to help you explore our collection before visiting us. Product availability, pricing, sizing, colours, fabrics, specifications and design details may change from time to time.

2. Appointments

Bridal appointments are available by appointment only.

Appointment availability, duration, booking fees and guest limits are as stated on our website at the time of booking.

Where an appointment booking fee applies, the fee and any applicable cancellation or rescheduling conditions will be communicated to you at the time of booking.

Our complimentary retry appointments are subject to our retry appointment policy and must be used within the specified timeframe communicated at the time of your original appointment.

We reserve the right to decline or reschedule an appointment where necessary, including where our appointment policies have not been followed.

3. Wedding gown purchases

When you purchase a wedding gown from Paperswan Bride, you are entering into an agreement with Bonjour Beloved LTD trading as Paperswan Bride for the supply of your selected gown.

Most wedding gowns are ordered from the relevant designer specifically for you and are not held in stock.

Before placing your order, we encourage you to carefully consider the gown, size, colour, fabric and any customisation options selected.

Your gown order will be confirmed in writing and will include the agreed purchase price and other relevant details.

Once an order has been placed with the designer, it may not be possible to cancel, amend or change the order. Any requested cancellation, amendment or change will be considered on a case-by-case basis and may be subject to charges from the designer or other costs incurred by Paperswan Bride.

Nothing in these Terms & Conditions limits any rights you may have under applicable New Zealand law.

4. Deposit and payment

Unless otherwise agreed in writing, a 50% deposit of the total order price is required when you place your wedding gown order.

The deposit must be paid before Paperswan Bride places your gown order with the relevant designer or supplier.

Unless otherwise specified in your Sale & Purchase Agreement, the remaining 50% balance is due within three calendar months from the date of your invoice.

For rush orders, full payment may be required before the gown can be collected.

Your payment schedule and amounts will be confirmed on your tax invoice and Sale & Purchase Agreement.

We will provide payment reminders before your balance is due.

Late payment

If full payment has not been received within 30 days of the invoice due date, overdue amounts may be subject to a late payment fee of 3% interest per month, calculated daily until the outstanding balance is paid.

If payment remains outstanding for 28 days after the invoice due date, Paperswan Bride may, after making reasonable efforts to contact you and discuss alternative payment arrangements, cancel the order.

Where an order is cancelled because of failure to comply with the agreed payment terms, Paperswan Bride may retain the deposit to the extent permitted by law to compensate us for losses associated with the cancelled order.

5. Gown sizing

Wedding gowns are ordered in standard designer sizes and are not made to measure unless specifically stated otherwise.

Our team will take measurements and provide sizing guidance based on the measurements available to us and the relevant designer's sizing chart.

The size ordered will be the standard size that most closely corresponds to the measurements taken at the time of ordering. Where appropriate, we will recommend sizing up rather than ordering a gown that is too small.

It is important that you tell us if you intend to lose or gain weight, or if you expect your body shape to change between the time your gown is ordered and when it is received.

Once your order has been placed, we cannot guarantee that the gown will fit in the same way if your measurements or body shape change.

Paperswan Bride cannot accept responsibility for additional costs arising because your measurements, height, weight or body shape have changed between the time your gown was ordered and the time it is received.

If a gown requires reworking, resizing or replacement because of a change in your measurements or body shape, any additional costs will be your responsibility.

6. Alterations and fitting

Alterations are not included in the purchase price of your wedding gown.

Because wedding gowns are ordered in standard sizes rather than made to measure, alterations are commonly required to achieve the best possible fit.

Paperswan Bride is happy to recommend bridal alteration specialists where appropriate. Any alteration provider we recommend is an independent business, and you will enter into a separate agreement directly with that provider.

Paperswan Bride has no business interest in the alteration specialists we recommend and is not responsible for organising, paying for or carrying out your alterations.

We recommend arranging your first fitting approximately 6–8 weeks before your wedding date, although your chosen alterations specialist should advise you on the appropriate timeframe for your gown.

We recommend obtaining a quote from your chosen alterations provider before any work commences.

Paperswan Bride is not responsible for alterations performed by an independent seamstress or tailor.

7. Gown delivery and collection

The expected delivery timeframe for your gown will be communicated to you when your order is placed.

Our standard expected delivery timeframe is generally approximately 5–6 calendar months from the date of order, unless otherwise specified by Paperswan Bride, the designer, or agreed with you.

Delivery timeframes are estimates and may be affected by designer production schedules, manufacturing delays, shipping, customs, courier delays or other circumstances outside our reasonable control.

We will keep you informed of significant delays where reasonably possible.

Once your gown arrives at the relevant Paperswan Bride boutique, we will contact you to arrange collection.

Your gown must be collected from the boutique within six weeks of Paperswan Bride notifying you that it has arrived.

If your gown is not collected within this timeframe, Paperswan Bride may arrange delivery to you at your expense.

Where delivery instructions are required and you do not provide those instructions within 14 days of our request, we may charge a reasonable storage fee from the day after our request.

8. Ownership and risk

Ownership of your wedding gown will pass to you once the gown has been delivered to you and the purchase price has been paid in full in cleared funds.

Until the purchase price has been paid in full, the gown remains the property of Paperswan Bride.

Risk in the gown remains with Paperswan Bride until completion of delivery, except where otherwise provided by law.

9. Changes to your gown order

Wedding gowns are ordered specifically according to the details confirmed at the time of purchase.

Requests to change the style, design, size, colour, fabric, customisation or delivery date after an order has been placed will be considered at Paperswan Bride's discretion and may result in additional charges.

We cannot guarantee that changes will be possible once an order has been placed with the designer.

Any agreed variation to your order should be confirmed in writing.

10. Designer products

Paperswan Bride stocks wedding gowns and products from independent bridal designers and brands.

Designer specifications, construction methods, fabrics, colours and design details may change from time to time.

We make reasonable efforts to ensure that the information and images displayed on our website accurately represent each product. However, minor variations in colour, fabric, construction or finish may occur.

Where a designer makes a material change to a product after an order has been placed, we will communicate the change to you where reasonably possible.

Nothing in these Terms & Conditions limits your rights under applicable New Zealand consumer law.

11. Warranties and product concerns

Paperswan Bride warrants that, subject to applicable New Zealand law, products supplied will be of acceptable quality and consistent with their agreed description and specifications.

If you believe your gown has been damaged, is defective, or does not match the agreed description or specifications, please contact Paperswan Bride as soon as possible.

For damage or an incorrect delivery, we ask that you notify us in writing within 5 days of receiving the item wherever reasonably possible.

Where appropriate, we may need to inspect the gown or obtain information from the relevant designer before determining the appropriate remedy.

Any remedy we provide will be in accordance with your rights under the Consumer Guarantees Act 1993 and other applicable New Zealand law.

Where a claim is accepted as a warranty or consumer guarantee issue, we may arrange an appropriate remedy, which may include repair, replacement or refund depending on the circumstances and your legal rights.

The gown should not be altered, worn, damaged or otherwise modified before a potential fault or issue has been discussed with Paperswan Bride, as alterations or modifications may affect our ability to assess the issue.

12. Returns, refunds and change of mind

Because wedding gowns are generally specially ordered for individual customers, we encourage you to carefully consider your purchase before placing your order.

We do not generally provide refunds, exchanges or cancellations where you have simply changed your mind about a purchase.

However, this does not limit any rights you may have under the Consumer Guarantees Act 1993 or other applicable New Zealand law.

If your gown is faulty, defective, does not match its description, or otherwise fails to meet a guarantee required by law, please contact us so that we can assess the issue and determine the appropriate remedy.

All sales remain subject to applicable New Zealand consumer law.

13. Sample Sale & Floor Stock Purchases

From time to time, Paperswan Bride offers wedding gowns and other bridal items from our boutique floor stock, sample collection or sample sales ("Sample Items").

Sample Items are gowns that have been used as boutique samples and may have been tried on by previous customers. As a result, Sample Items may show signs of wear, handling, marking, alterations, fabric changes or other imperfections consistent with their use as a sample.

Condition of Sample Items

Sample Items are sold in the condition displayed at the time of purchase.

It is the customer's responsibility to carefully inspect the Sample Item before purchasing and to raise any concerns about its condition with a member of the Paperswan Bride team at the time of purchase.

By purchasing a Sample Item, you acknowledge that you have had the opportunity to inspect the item and are satisfied with its condition, including any disclosed or visible signs of wear or other imperfections.

Sample Items are not covered by the general warranty that applies to new, made-to-order gowns, except to the extent that any rights or remedies cannot legally be excluded under New Zealand law.

Sample Sale purchases are final

Unless otherwise required by law, all Sample Item and Sample Sale purchases are final.

We do not offer refunds, exchanges, store credit or replacement of Sample Items simply because you have changed your mind, the item does not fit as expected, or you later identify a condition that was visible or reasonably apparent at the time of purchase.

Nothing in these Terms & Conditions limits or excludes any rights you may have under the Consumer Guarantees Act 1993 or other applicable New Zealand consumer law.

Payment

Payment for Sample Items must be made in full at the time of purchase, unless Paperswan Bride has expressly agreed otherwise in writing.

Sample Items will not be released until full payment has been received in cleared funds.

Alterations

Sample Items are sold as displayed and may require alterations to achieve the desired fit.

Alterations are not included in the purchase price unless expressly stated otherwise.

Any alterations required after purchase are the responsibility of the customer and must be arranged and paid for by the customer.

Paperswan Bride is not responsible for alterations undertaken by an independent seamstress or tailor.

Transport and storage

Once a Sample Item has been collected by the customer or handed to a courier or other transport provider arranged by or on behalf of the customer, the customer is responsible for taking reasonable care of the item.

Paperswan Bride is not responsible for damage or defects that occur after the item has been collected or transferred to the customer's nominated transport provider where that damage results from transport, inappropriate handling, storage or the customer's negligence.

We recommend that Sample Items are transported and stored carefully and in accordance with any care instructions provided by Paperswan Bride.

Sample Sale promotions

Specific terms may apply to individual Sample Sales, including sale dates, pricing, payment requirements, collection arrangements and any specific condition disclosures.

Where additional terms apply to a particular Sample Sale, those terms will be communicated at the time of the sale and will apply in addition to these Terms & Conditions.

14. Pricing

All prices displayed on our website are in New Zealand Dollars (NZD) and include GST where applicable, unless otherwise stated.

We make reasonable efforts to ensure that all pricing displayed on our website is accurate.

Prices may change at any time.

The price applicable to your wedding gown will be the price confirmed at the time your order is placed.

Once your gown order has been confirmed at an agreed price, we will not increase the price of that order unless otherwise agreed with you.

15. Promotions and discounts

From time to time, Paperswan Bride may offer promotions, discounts, trunk shows, sample sales or other special offers.

Specific terms may apply to individual promotions and will be communicated at the time of the promotion.

Unless otherwise stated, promotions cannot be combined with other offers, redeemed for cash or applied retrospectively to previous purchases.

We reserve the right to withdraw or amend a promotion where necessary, subject to applicable law.

16. Website information and images

We make reasonable efforts to ensure that information on our website is accurate and current.

However, we cannot guarantee that all information will always be complete, accurate, current or free from errors.

Product photographs are intended as a representation of the product. Colours and appearance may vary depending on lighting, photography and screen settings.

Images may also show styling, accessories or alterations that are not included with the gown unless specifically stated.

We reserve the right to correct errors and update information on our website at any time.

17. Intellectual property

All content on the Paperswan Bride website, including photographs, images, text, graphics, logos, branding, designs and other material, is owned by or licensed to Paperswan Bride unless otherwise stated.

You must not reproduce, copy, modify, distribute, publish or commercially exploit our website content without our prior written permission.

18. Website use

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of Paperswan Bride or any third party.

You must not attempt to interfere with the operation or security of our website, introduce malicious software, gain unauthorised access to our systems or use our website for fraudulent or unlawful purposes.

We do not guarantee that our website will always be available, uninterrupted or free from errors.

19. Privacy and personal information

We collect and use personal information in accordance with our Privacy Policy and applicable New Zealand privacy law.

We may collect information including your name, contact details, appointment information, measurements and order details where reasonably necessary to provide our products and services.

We may use your information to:

·process and manage your orders;

·arrange and manage appointments;

·communicate with you about your purchases;

·provide customer service;

·arrange delivery and collection;

·process payments;

·improve our products, services and website; and

·send marketing communications where you have consented to receive them.

You may unsubscribe from marketing communications at any time by following the unsubscribe instructions included in our emails or contacting us directly.

We may use cookies and similar technologies to enable website functionality, understand website usage and improve your experience.

We may disclose personal information where required or permitted by law or where reasonably necessary to provide our services, including to payment providers, couriers, website providers and relevant service providers.

You may request access to, or correction of, personal information we hold about you, subject to applicable law.

We will keep confidential and secure personal or other information you provide to us that would reasonably be expected to be confidential.

We may disclose information where required or permitted by law or where reasonably necessary to provide our products and services.

21. Third-party websites and services

Our website may contain links to third-party websites, including designer websites, payment providers, social media platforms and other services.

We are not responsible for the content, security, privacy practices or availability of third-party websites.

Your use of third-party websites and services is subject to their own terms and conditions and privacy policies.

22. Events outside our reasonable control

Paperswan Bride will not be responsible for delays or failures caused by circumstances beyond our reasonable control.

These may include natural disasters, severe weather, fire, flood, pandemic, industrial action, transport disruption, supply chain disruption, customs delays, changes in law, government action, designer or manufacturer delays, theft, criminal damage, interruption to utilities or other events outside our reasonable control.

Where such an event affects your order or service, we will take reasonable steps to communicate with you and work towards an appropriate solution.

23. Limitation of liability

To the maximum extent permitted by law, Paperswan Bride, its directors, employees, contractors and agents will not be liable for indirect, consequential or unforeseeable loss arising from your use of our website or your purchase of products or services from us.

Nothing in these Terms & Conditions excludes, restricts or modifies any right, remedy, guarantee or liability that cannot lawfully be excluded, restricted or modified under New Zealand law, including your rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.

Where we are legally permitted to limit our liability, our liability will be limited to the extent permitted by law.

24. Complaints and disputes

If you have a concern about a product or service purchased from Paperswan Bride, please contact us as soon as possible and provide details of the issue.

We will endeavour to understand the issue and work with you to reach a fair and appropriate resolution.

If a dispute arises in relation to a purchase or agreement and cannot be resolved directly between you and Paperswan Bride, either party may pursue any remedies available under New Zealand law.

25. Governing law

These Terms & Conditions, your use of our website and your purchase of products and services from Paperswan Bride are governed by the laws of New Zealand.

Any dispute arising in connection with these Terms & Conditions will be subject to the jurisdiction of the courts and tribunals of New Zealand.

26. Changes to these Terms & Conditions

We may update these Terms & Conditions from time to time.

The most current version will be published on our website and will apply from the date stated at the top of this page.

Any changes to the terms applying to an existing gown order will not affect the terms of a signed Sale & Purchase Agreement unless otherwise agreed in writing.

27. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, that provision will be read down or removed to the extent necessary, and the remaining provisions will continue to apply.

28. Entire agreement

For an individual wedding gown purchase, the written Sale & Purchase Agreement, order confirmation, tax invoice and any written variations agreed between you and Paperswan Bride together form the agreement relating to that purchase.

The website Terms & Conditions apply to your use of our website and, where relevant, to your purchase of products and services from Paperswan Bride.

Any variation to an individual gown order must be agreed in writing by you and Paperswan Bride.
